Welcome to Betal, the dedicated app for flower enthusiasts ("App"). By accessing or using the App, you agree to be bound by this User Agreement ("Agreement") and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the App.
Betal provides a platform for flower enthusiasts to share posts, access detailed floral knowledge, obtain practical planting tips, learn about flower languages, and use an AI recognition function to identify flower species. The App is available without the need for account registration ("Service").
You agree to use the Service in compliance with all applicable laws, including but not limited to the laws of Hong Kong. You shall not use the App for any unlawful purpose or in any way that violates the rights of others.
You agree to use the floral knowledge, planting tips, and other content provided in the App for informational purposes only. The App does not guarantee the accuracy, completeness, or timeliness of such content, and you rely on it at your own risk.
When using the AI recognition function, you agree to upload only images of flowers and plants. You warrant that you have the necessary rights to upload any images you provide to the App and that such uploads do not infringe upon any third-party rights, including copyright.

All content included in the App, such as text, graphics, images, logos, and software, is the property of Betal or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. This Agreement does not grant you any rights to use such content except as necessary to use the Service.
By sharing posts or other content through the App ("User Content"), you grant Betal a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the Service. You retain all ownership rights in your User Content.
You warrant that your User Content does not infringe upon any third-party rights and that you have the right to grant the license set forth above.
The Service is provided on an "as is" and "as available" basis. Betal makes no representations or warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Betal does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. The information provided through the Service is for general information purposes only and should not be relied upon as professional advice.
To the maximum extent permitted by law, Betal shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangibles, resulting from your use or inability to use the Service.
Nothing in this Agreement shall limit or exclude liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
You agree to indemnify, defend, and hold harmless Betal and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Service or your violation of this Agreement.
Betal reserves the right to terminate or suspend your access to the Service at any time, without prior notice, for any reason, including but not limited to a breach of this Agreement. Upon termination, your right to use the Service will immediately cease.
Betal reserves the right to modify this Agreement at any time. Any changes will be effective immediately upon posting the revised Agreement in the App. Your continued use of the Service after the posting of changes constitutes your acceptance of such changes.
This Agreement shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

This Agreement constitutes the entire agreement between you and Betal regarding the use of the Service, superseding all prior agreements and understandings, whether written or oral.
